2. Purpose of PAIA manual
All private bodies in South Africa must have a PAIA manual. The Information Regulator said that, "effective from 01 January 2022, all public and private bodies (including those that are currently exempted) must have their PAIA Manual available at their principal place of business or on their web site".
This manual helps you to:
- see which of our records you can get without a formal PAIA request
- understand how to ask for a record, by seeing the subjects we hold records on and the categories of records under each one
- see which records we keep because another law requires it
- find the contact details of the person who will help you with a request
- find the Regulator's Guide on how to use PAIA, and how to get it
- see whether we process personal information, why, about whom, and what kind
- see who we may share personal information with
- see whether we send personal information outside the Republic, and to whom
- see how we keep personal information safe

The Information Regulator publishes a Guide on how to use PAIA (October 2021 version) on https://inforegulator.org.za/paia-guidelines/, in English and the other official languages. The Guide explains, among other things, how to make a request to a private body, the help the Regulator can give, and the remedies open to you, including a complaint to the Regulator and an application to court.
You can get the Guide:
- from the Regulator's website: https://inforegulator.org.za/paia-guidelines/
- by asking us at [email protected]. Tell us which official language you want, and we will send you the Regulator's version in that language where the Regulator publishes one.

How to ask for a record from us
- Fill in Form 2, "Request for Access to Record" (Regulation 7). You can download it from the Information Regulator's website. Attach proof of your identity.
- Send it to the Information Officer by email to [email protected]. If you want to post it or deliver it by hand, ask the Information Officer for the address.
- Say which record you want, in enough detail for us to find it, and how you want to receive it.
- If you are asking on behalf of someone else, show that you have their authority.
- Pay the request fee (see "Fees" below).
Fees
PAIA allows a private body to charge a request fee and an access fee. The Information Regulator's fee structure for private bodies is:
- request fee, "payable by every requester": R140.00
- copies: R2.00 per A4 page or part of a page
- search and preparation: R145.00 for each hour or part of an hour, not counting the first hour, up to a maximum of R435.00
- deposit: if the search takes more than 6 hours, you may be asked to pay one third of the fee upfront
If you only want us to confirm whether we hold personal information about you, POPIA section 23(1)(a) says that confirmation is free of charge. We will tell you any fee before we do the work.
When we will decide
We'll decide on your request as soon as we reasonably can, and within 30 days. We may extend this once, by up to 30 more days, in the cases PAIA allows (for example a very large request), and we'll tell you why within the first 30 days. If we don't decide in time, PAIA treats your request as refused.
Why a request may be refused
Access can be refused only on the grounds in Part 3, Chapter 4 of PAIA (sections 63 to 69): for example to protect another person's privacy, a third party's commercial or confidential information, someone's safety, legally privileged records, or our own commercial information. Section 70 says a record must still be released where the public interest in it clearly outweighs the harm.
If you're unhappy with our decision
PAIA's internal appeal (section 74) is for public bodies. If you are unhappy with a decision by the head of a private body such as QAC, for example a refusal, section 77A(2) of PAIA says you may complain to the Information Regulator within 180 days of the decision. The Regulator's own guidance says that, for private bodies, a complaint can be made where a request is refused or not answered, using PAIA Form 5 sent to [email protected].
Section 78 of PAIA covers applications to court. It says a requester may apply to court after using the complaints procedure in section 77A, and sets a time limit of 180 days.

8. Processing of personal information
8.1 Purpose of processing personal information
To look at a business's funding need, contact the person who enquired about it, and, if they want to go ahead, put the application to a funder that suits it. We also keep the records the law requires. We don't sell personal information. Our privacy notice has the full detail.
8.2 Description of the categories of data subjects and of the information or categories of information relating thereto
| Categories of data subjects | Personal information that may be processed |
|---|---|
| People who send us an enquiry | Name, cell number, business name, email address, what the funding is for, roughly how much is needed, how they'd like to be contacted, their consent, and the website that first sent them to us |
| Business owners, directors and members of businesses that go ahead | Bank statements, company documents, ID details and other financial information that a funder asks for |
| Website visitors | Visit counts without cookies or IP addresses, as our privacy notice describes. Our hosting company handles IP addresses to serve and protect the site |
| Contacts at funders and service providers | Names and business contact details |
8.3 The recipients or categories of recipients to whom the personal information may be supplied
| Category of personal information | Recipients or categories of recipients |
|---|---|
| Enquiry and application details | Funders relevant to the client's need, only if the client wants to go ahead. We tell the client which funder we're approaching first |
| Enquiry form data | Our operator, Muswell Rose Consulting Ltd (United Kingdom), which runs the website, form and lead database for us under a written operator agreement |
| Website, form, database and email data | Our hosting and service providers: Cloudflare, Inc. (website and form), Supabase (lead database and visit counts), Resend (enquiry emails) and our South African email host |
| Phone and WhatsApp messages | WhatsApp LLC, when a client chooses to talk to us on WhatsApp |
8.4 Planned transborder flows of personal information
Yes. An enquiry sent through the website form is stored and handled outside South Africa: our lead database is on Supabase servers in Germany, the website and form run on Cloudflare, Inc., a United States company with servers around the world, enquiry emails go through Resend, a United States company sending from Ireland, and our operator is in the United Kingdom. WhatsApp is run by WhatsApp LLC in the United States, part of Meta, and it stores information in data centres around the world.
POPIA section 72(1) allows a transfer to a third party in another country only in set cases. We rely on two: the transfer is needed "for the implementation of pre-contractual measures taken in response to the data subject's request" (s72(1)(c)), and the person's consent, given on the enquiry form (s72(1)(b)).
Anyone who would rather their details stayed in South Africa can call or email us instead of using the form or WhatsApp.
8.5 General description of information security measures to be implemented by the responsible party to ensure the confidentiality, integrity and availability of the information
- The website and enquiry form use an encrypted connection (HTTPS).
- Our operator processes personal information only on our instructions, under a written agreement that requires it to keep the information secure, as POPIA sections 20 and 21 require.
- We keep an enquiry for 12 months after our last contact, then delete it, unless the person becomes a client.
Our privacy notice has the full detail.
